The basis for the new trial rides on J&J’s claim that the original verdict was unfair and a result of error by the plaintiff’s legal team. Johnson and Johnson stand firmly with the safety of their products. The company argues the Oregon woman’s ovarian cancer was caused by other factors—namely her exposure to asbestos from a nearby factory. Over 62,000 claims from ovarian cancer plaintiffs have been brought upon Johnson and Johnson for their asbestos-contaminated talc products. However, the company has settled many claims and continues to be a part of current litigation, including paying out a $63.3 million verdict in another mesothelioma case.
