David Halpern Speaks at the Perrin Conferences National Asbestos Litigation Conference

David Halpern, attorney at the Halpern Law Firm, attended and spoke at the Perrin Conferences National Asbestos Litigation Conference in Charleston, South Carolina. The Conference took place from September 12th to September 13th. A full two-day conference, a lot of topics and insights were discussed.

Day 1

The Conference included a variety of topics and a variety of speeches by various attorneys and others. The conference began on September 12th with breakfast and opening remarks, followed by a discussion on national trends driving asbestos litigation. Topics discussed during this panel included recent verdicts, appellate update, expansion of plaintiff asbestos firms and filing trends, hot jurisdictions and future projects.

The next panel of speakers discussed cosmetic talc. Topics included in this discussion were recent talc verdicts, luxury products vs. general products, who is wearing makeup? And who is buying baby powder, exposure, dose and hot jurisdictions for cosmetic talc.

After a brief break, another panel commenced, this time discussing the perspective of the insurer, with topics such as perspectives on emerging high-risk jurisdictions, carrier views on trial activity in new jurisdictions and collaboration and communication among insurers, insureds and counsel in the tripartite relationship.

After lunch, a panel discussed the topic, “Assessing Case Risk in Asbestos Litigation: What Really Drives Case Value?” Topics discussed included tools and technology, tolling agreements, access and personal relationships and primary factors that impact risk on a case.

Next came bankruptcy updates. The speakers talked about the how’s and why’s of bankruptcies, future predictions, Texas two-step, the intersection of talc and asbestos litigation and meso and ovarian groups and their perspectives on settlements.

Finally came the judicial round table, before the first day of discussions ended.

Day 2

The second day involved even more topics and discussions. The topic discussed in the morning, in which our very own attorney at the Halpern Law Firm, Dave Halpern, spoke about, was personal jurisdiction and non-traditional jurisdictions, in which the nuances and challenges of taking cases in unique jurisdictions without historical asbestos filings was discussed. Dave brought insights regarding the state of Pennsylvania.

The next topic discussed was chronic legacy insurance policies. Topics included in the discussion were defense issues related to defunct entities, restructuring and bankruptcy, dissolution, receivership and identifying historical insurance assets.

Next there was an in-house counsel perspective during which evolving challenges defending national asbestos litigation were discussed. After that, there was a panel on ethics and discovery practice and motions. Discussions included the importance of answering discovery honestly and the ethical responsibility of maintaining good relations between plaintiff and defense attorneys.

Next came a medical and scientific literature update on asbestos and mesothelioma. There was a pleural mesothelioma classification update and discussion on the status of genomics in mesothelioma litigation.

The last topic was regarding corporate representatives. The speakers talked about the impact of recent rulings limiting testimony of corporate representatives to their personal knowledge. They also spoke about the personal knowledge of a corporate representative, what the appropriate limitation of testimony is and plaintiff and defendant benefits to limiting the scope of testimony.
